ШТУРМАНСКАЯ РАСПИСКА, погрузочный ордер — документ, подписанный грузовым помощником капитана (старшим помощником), удостоверяющий принятие груза на борт судна. Если груз погружен не в «надлежащем по внешнему виду состоянии», то в штурманскую расписку вносят соответствующую оговорку. [c.475]
Договором предусматривается обязательство грузовладельца вручать погрузочный ордер (экспортное поручение) порту заблаговременно, но не менее, чем за 48 часов до начала загрузки судна, вместе с грузовым списком, с подтверждением таможни о выпуске товара на экспорт и с приложением ветеринарных, фитосанитарных (карантинных) свидетельств и прочих товаросопроводительных документов (спецификаций, сертификатов и др.), кроме того, в наших погрузочных ордерах-поручениях содержатся сведения о местах складирования грузов, номерах заказ-нарядов (см. приложение №28). Если терминал не соблюдал действующие на транспорте правила и инструкции грузовладельца о порядке складирования, хранения и перевалки того или иного груза если порча груза произошла по причине нарушения портом очередности отгрузки, указанной в погрузочном ордере-поручении если по вине порта оказалась поврежденной тара груза, следствием чего явилось причинение грузу ущерба. Первым документом является погрузочный ордер в качестве предложения — оферты в письменном виде перевозчику — заключить договор перевозки и патучить от перевозчика письменное доказательство его заключения в форме коносамента (или, см. ниже, в форме морской транспортной накладной). [c.149]
Для отправки своего груза судном, работающим по объявленному расписанию, отправитель (экспедитор) направляет агенту по почте, телексу, факсу или телефону заявку на отправку конкретной партии груза с указанием характеристики груза, названия судна и даты отхода по расписанию с приложением или проекта погрузочного ордера (см. приложение №23 — E SI), упаковочных листов и других необходимых документов или только основных данных о грузе. К. составляется органом морского транспорта, принимающим груз к перевозке (не менее чем в 2 экземплярах, один из к-рых выдается грузоотправителю, а другой следует вместе с грузом), на основании письменного объявления (погрузочного ордера), составленного и подписанного предприятием (или организацией), отправляющим груз (грузоотправителем), или его экспедитором. В погрузочном ордере указываются сведения о грузе и важнейших условиях его перевозки, к-рые вносятся затем в К. В случае указания в погрузочном ордере неправильных сведений грузоотправитель несет перед перевозчиком имущественную ответственность, если это причинило к.-л. убытки или вред. При перевозке грузов между сов. портами К. удостоверяет заключение грузоотправителем и перевозчиком договора перевозки и прием перевозчиком указанного в К. груза. При перевозках в заграничном сообщении К. может выполнять также функции товарораспорядительного документа, т. е. перевозимый груз может быть продан, заложен и т. п. путем совершения соответствующих сделок с К. Предъявление К. является обязательным условием для получения грузополучателем груза от перевозчика. Представление К. обязательно также при предъявлении к перевозчику большинства связанных с перевозкой претензий и исков. Содержание К., а также порядок его составления и выдачи определяются Кодексом торгового мореплавания СССР, Общими правилами перевозки грузов, пассажиров и багажа по морским путям сообщения на судах Министерства морского флота и другими правилами, издаваемыми Министерством морского флота.
