Application for a summons

If the invoice, the accumulated interest or the collection fees are not paid despite the recovery actions, the creditor may draft an application for a summons and deliver it to the local Court. The costs resulting from the compilation and processing of the application are €115, €145 or €175 depending on the unsettled amount of the original invoice.

The District Court then issues a summons with a 14-day deadline within which the debtor has to respond to the claim in accordance with the instructions given in the summons. If the debtor fails to respond, the District Court issues a judgement by default allowing the claimant’s action, which causes a payment default entry in the debtor’s credit information register.

If you disagree with the claims presented, you need to respond to the summons by submitting a statement to the District Court in accordance with the instructions given. The District Court reviews the case as a civil action and asks the creditor for a statement regarding the matter. If necessary, the issue is finally decided in court. The District Court pronounces its judgement based on the statements and evidence provided. Contesting the claim may result in additional litigation costs. In civil actions, the District Court costs of proceedings is 260 euros.

Judgement of the District Court

The purpose of the application for a summons is to secure a judgement in the matter, which in this case means that the recovery operations will continue by the enforcement authorities.

If the debtor does not respond to the claim within the given time limit, the Court issues a judgement by default allowing the claimant’s action. The judgement causes a payment default entry to credit information register.

If the summons is contested, the Court reviews the case as a civil action. If necessary, the issue is finally decided in court. The District Court pronounces its judgement based on the statements and evidence provided.

Recovery proceedings

The District Court’s judgement serves as grounds for enforcement. The debt is transferred to recovery proceedings and the debtor informed of the matter with a notification sent by the enforcement authority. The notification specifies the debt to be collected, and contains payment data and contact details of the enforcement officer in charge of the matter.

Recovery proceedings add to the collection fees as per the recovery authority’s own tariffs. If you are unable to pay the debt by the due date specified in the enforcement notification, the recovery authority conducts an enforcement inquiry and begins to distrain distrainable assets or garnishable income against the debt.

If no such assets or income exists, the authority declares the lack of means and returns the case to the debt collection agency. The creditor may refile the enforcement request until the judgement on which the collection proceedings are based expires in 15-20 years.

Public fees, such as healthcare fees, taxes, insurance premiums and their accrued interests and collection costs are directly distrainable, and can be transferred to collection without a court ruling.

ROPO’S COLLECTION AND INVOICING CUSTOMERS

The purpose of this privacy statement is to provide the persons who are subject to collection and invoicing assignments by the Ropo Group – which comprises RopoHold Oy, Ropo Capital Oy, Ropo Finance Oy and Ropo Invest Oy (hereinafter referred to as “Ropo“) – a comprehensive picture of the personal data that Ropo collects on them, the purposes for which the data is used, and to whom the data may be disclosed. This privacy statement also provides information on the obligations and legislation that Ropo adheres to in the processing of personal data.

The privacy statement applies to all invoicing or collection customers as well as persons authorised by them or their trustees whose personal data is processed by Ropo as a controller in connection with the services it provides (hereinafter referred to as “data subject“).

1 Definition of personal data

Personal data” means all data relating to data subjects whereby he/she may be directly or indirectly identified, as defined in the EU General Data Protection Regulation (2016/679) (“GDPR“). Data whereby the data subject may not be directly or indirectly identified is not personal data.

Ropo adheres to the GDPR as well as other applicable data protection legislation and good data processing practices.

Ropo collects and processes data that is necessary for the provision of its services. This applies to data received from the creditor, data provided by the data subjects themselves and data collected from other sources.

Ropo will store personal data for as long as is necessary for the purposes specified in this privacy statement unless the law requires the retention of personal data for a longer period of time (for example, specific legal, accounting or reporting responsibilities and obligations) or unless Ropo needs the data for drawing up or presenting a legal claim or for defending against a legal claim.

Ropo will store the personal data of invoicing and collection customers for the period required for the invoicing and/or collection, and for the period required by law thereafter.

After the storage period of personal data has expired, the data will be deleted within a reasonable time.

6 Processors and other recipients of personal data

Personal data of data subjects may be disclosed to a third party in situations permitted and mandated by assignment contracts and prevailing legislation, including:

8 Principles of personal data protection and processing security

Ropo processes personal data in a way that aims to ensure the proper security of personal data, including protection against unauthorised processing and accidental loss, destruction or damage.

Ropo uses appropriate technical and organisational protective measures to ensure this, including the following protective measures:

Ropo’s network and servers are protected by firewall and other technical measures. Data readout, transmission and deletion rights are limited by access rights and passwords. Access rights are granted to persons handling collection and other assignments who have personal and job description-specific user rights and who have received instructions. Users of the filing system are identified and controlled and their access rights checked at regular intervals. The staff have received instructions on the safe use of passwords.

The material is stored in a locked space of the company, equipped with modern security systems, with access rights limited to persons assigned to it for their duties. The premises are equipped with access control.

Data is printed only when needed, and printouts are securely destroyed immediately after processing. The staff have been instructed that the personal identity codes of data subjects shall not be unnecessarily entered in documents.

All persons processing personal data have a confidentiality obligation, based on the Privacy Act and contractual confidentiality terms, on matters pertaining to the personal data processing of data subjects.

In accordance with this privacy statement, Ropo may outsource processing of personal data to service providers or subcontractors, but Ropo, through adequate contractual obligations, shall ensure that personal data is processed properly and lawfully.

9 Rights of data subjects and realisation of rights

The data subjects have the rights guaranteed by current data protection legislation.

Right of access to data

The data subject has right of access to the data on him/herself and, at his/her request, the right to receive a copy of the data.

The request must be accompanied by a copy of an identity document containing a signature, which verifies identity before providing the data.

Right to data rectification and erasure

The data subject may notify the controller’s contact person mentioned in section 12 of this privacy statement of any error he/she has detected in his/her data. After verification of the data subject’s identity, the inaccurate data will be rectified. If the data rectification is denied, the data subject will be notified in writing.

Ropo will erase, on its own initiative or at the request of the data subject, and complete any inaccurate, unnecessary, incomplete or outdated personal data for the purpose of processing in the filing system.

Right to data portability, restriction of processing, object to processing and withdrawal of consent

Under the current data protection legislation, the data subject has the right, in certain situations, to request the transfer of his/her data to another controller.

In a situation where personal data suspected inaccurate cannot be rectified or erased, or there is confusion about the request to erase, the company will restrict access to the data.

The data subject has the right to object to the use of data for a particular type of processing, such as direct marketing. Ropo Capital does not use its invoicing or collection customers for direct marketing or disclose data for such purposes.

The data subject has the right not to be subject to a decision which is based solely on automated processing and which has significant legal or similar effects on him/her. Ropo does not make automated processing decisions on the data subject that would have significant legal or similar effects on him/her.

If processing is based on consent, the data subject has the right to withdraw consent. The withdrawal has no effect on processing prior to the withdrawal.

10 Right to file a complaint with a supervisory authority

The data subject has the right to file a complaint with a data protection authority if the data subject considers that his/her personal data has been processed in violation of current legislation. In the European Union, the complaint may be filed with a data protection authority, in particular with the data protection authority in the country of residence or employment or with the data protection authority in the state where the alleged infringement has occurred. In Finland, the data protection authority is the data protection ombudsman: tietosuoja.fi.

SLP Kustannus, a subsidiary of Suomalainen Lehtipaino Oy and the new owner of Alma Media’s print publishing business in Kainuu, is outsourcing its invoicing and payment control processes to Finnish Ropo Capital. The service solution will be based on digitisation and automation, and expected to support the company’s growth strategy, generate resource savings and improve profitability.

SLP Kustannus publishes Kainuun Sanomat and several other newspapers in Northern Finland. As part of its operational restructuring, it will outsource its invoicing, ledger and payment control to Ropo Capital, a Finnish company specialised in financial management services.

The company submits some 100,000 subscription and ad invoices a year, all of which will be processed through Ropo Capital’s Ropo 24 system.

– Ropo Capital stood out from its competitors for its pricing model, which from a buyer’s perspective is very clear and safe. All costs were listed in the offer and the buying was made easy. The fact that the deployment phase entailed no additional costs for us was also a contributing factor. Whole cost structure has been clear from the start, says Erkki Heikkilä, Publishing Manager at SLP Kustannus.

– We are talking about extensive cooperation, which covers the integration of the invoicing and payments monitoring process with subscription management, advertising sales and accounting. Manual work has been reduced to a minimum and data transfer largely automated. The new system will cut our costs significantly and is an important part of our growth strategy, Heikkilä continues.

New invoicing process in two months

As a subsidiary of Suomalainen Lehtipaino, SLP Kustannus is bound by the agreement between Suomalainen Lehtipaino and Alma Media, according to which Suomalainen Lehtipaino as a group is responsible for the entire production chain of its print media from publishing to printing and distribution. Due to these changes, the outsourcing had to be done quickly and the whole subscription-invoicing chain reformed.

– The entire process from subscription to invoicing was completely restructured in two months. Deadline and cooperation between the various operators posed the greatest challenges. It was important to get the different systems to work effectively together. Ropo Capital was up for the challenge, and we are very pleased with the progress of the project, Heikkilä comments.

Rapid deployment was supported by Ropo Capital’s experience in comprehensive solutions tailored for the media and publication industry, as well as its software partnership with Jaicom Oy, a company responsible for SLP Kustannus’ subscription system, and Anygraaf in charge of SLP Kustannus’ advertisement management system. Ropo Capital and its partners have realised similar solutions for Fokus Media and Joutsen Media, among others.

– The whole publishing industry is in a transition phase. We find the segment highly interesting and will continue our investments there. Ropo Capital finalizes brand consolidation – BAHS Kapital rebranded Ropo Capital Norway

Rapidly growing Ropo Capital has unified its brand in Finland, Sweden and Norway. The company has accelerated its Nordic expansion through acquisitions and is now finalizing its one brand strategy by merging the latest acquisition, BAHS Kapital AS in Norway, under the Ropo Capital brand.

Credit management and debt collection company BAHS Kapital joined the Ropo Capital Group via acquisition in March 2021. From 26 August onwards, the company is operating under the name Ropo Capital and the rebranding will be complete by September.

The name change is part of Ropo’s brand strategy, in which all the Group’s acquired businesses are brought under a single Ropo Capital brand name and identity to support growth. The goal is to grow into the leading provider of invoice lifecycle management in the Nordic countries.

Invoicing volumes on the rise

Compared to many of its competitors, Terveystalo is a young company. Growth for the leading Finnish healthcare service provider happened in the 2000s, for 15 years. The Group is a result of many company acquisitions, which have also led to the expansion of its services. Presently Terveystalo is moving towards oral health services, where it plans to become the first truly nationwide dental clinic chain in Finland.

Inorganic growth has been noted in the partnership between Ropo Capital and Terveystalo. The health service giant has performed over 130 acquisitions and also plans to continue on that path in the future. For Ropo Capital, this means considerable growth in the material under its management.
